These Terms of Use ("Terms") are an agreement between you and Sundapple ("we", "us"), the developer of the Fishion mobile application and related services (together, the "App"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
Our Privacy Policy explains how we handle your data and forms part of these Terms.
You must be at least 13 years old to use the App. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf. You are responsible for your account and for keeping your login credentials secure.
You are solely responsible for complying with all fishing laws and regulations that apply to you, including licences and rod permits, protected species, size and bag limits, closed seasons, and access rights. Information shown in the App (including AI-generated information) does not constitute legal, regulatory or safety advice.
The App includes AI-powered features such as catch identification from photos and the AI Coach. AI output can be wrong, incomplete or outdated. In particular:
Some features require an account. You agree to provide accurate information and to notify us of any unauthorised use of your account. We may suspend or close accounts that violate these Terms. You can request deletion of your account by contacting us at the email above or using in-app options where available.
The App lets you submit content such as catch logs, photos, spot intel, and profile information ("User Content"). You keep ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, display and process your User Content as needed to operate and improve the App, including showing it to other users where a feature is designed to do so (for example, Arena results or intel you choose to sell).
You must not submit content that is illegal, infringing, deceptive, harassing, or that discloses another person's private information. Intel you offer to other users must be honest and based on your genuine knowledge; deliberately false intel may result in loss of coins, reputation penalties, or account suspension. We may remove content that violates these Terms.
Anonymous, coarsened catch data (location rounded to approximately 1 km) may be aggregated for community features as described in the Privacy Policy.
Coins, trophies, streaks, reputation and other in-app items are virtual features with no monetary value. They cannot be redeemed for cash, transferred outside the App, or sold. We may adjust, reset or discontinue virtual items and balances to maintain fairness or as part of changes to the App. Virtual items obtained through cheating, exploits or fraudulent intel may be removed.
Fishion may offer a paid subscription ("Fishion Pro") purchased through the Apple App Store or Google Play. Billing, renewal, free trials, cancellation and refunds for such purchases are handled by Apple or Google under their terms:

You agree not to:
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for your personal, non-commercial use, subject to these Terms and the applicable app store rules. The App, including its design, code, branding and content we provide, is owned by us or our licensors and protected by intellectual property laws. Map data and other third-party materials remain subject to their own licences and attributions.
The App relies on third-party services, including map tile providers, AI providers, email delivery, hosting, and the Apple App Store / Google Play. We are not responsible for third-party services, and their availability may affect App features.
The App is provided on an "as available" basis. We may add, change, suspend or remove features (including community features, the Arena, and AI features) at any time. We will try to give notice of material changes where reasonably practicable, but we do not guarantee that the App or any feature will always be available or error-free.
You may stop using the App at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the App. Sections that by their nature should survive termination (including Sections 3, 4, 6, 10, 14 and 15) will survive.
To the maximum extent permitted by law, the App is provided "as is" and "as available" without warranties of any kind, and we exclude all implied warranties, including fitness for a particular purpose and accuracy of content (including AI output, map spots and conditions data).
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the law of England and Wales, and nothing in these Terms affects your statutory rights as a consumer.
Subject to the paragraph above, we will not be liable for: losses arising from your fishing activities or presence near water; your failure to comply with fishing regulations; reliance on AI output or other App content; loss of virtual items; or indirect or consequential losses. Where liability cannot be excluded, our total liability in connection with the App is limited to the greater of £50 or the amounts you paid us for the App in the 12 months before the claim arose.
These Terms are governed by the law of England and Wales. If you are a consumer resident elsewhere, you keep the benefit of any mandatory consumer protections of your country of residence, and you may bring proceedings in your local courts where the law allows.
We may update these Terms from time to time. If we make material changes, we will give notice in the App or by other reasonable means before they take effect. Continuing to use the App after changes take effect means you accept the updated Terms.
